  2. Some of the newer members may not be aware of the ongoing FDA Vs. Smoke Everywhere & NJOY Case. So here is a summery that was put together by Sun from ECF. This is an action sounding in equity. In April of 2009, Smoking Everywhere, Inc.(SE) filed suit against the Food and Drug Administration (FDA), to "stop FDA from improperly exceeding its delegated authority by attempting to regulate electronic cigarettes" to the extent that FDA declared such products to be a new drug and/or new drug device combination. SE further alleges that FDA exceeded its statutory authority by adding SE’s products to an FDA Import Alert list, thus allegedly preventing their admittance into the United States. In addition to the Complaint, SE filed a temporary restraining order and preliminary injunction Motion. SE claims that its electronic cigarette allows people to inhale vaporized nicotine without the cancer causing agents found in cigarettes. SE claims that the Electronic Cigarette is a "tobacco product" SE contends that FDA exceeded its authority by claiming that electronic cigarettes are combination drug/device products that require FDA approval. SE argues that Congress has clearly indicated that FDA does not have the authority to regulate tobacco products relying in part on the holding in FDA v. Brown & Williamson Tobacco Corp., 529 U.S. 120 (2000). SE also pleads that FDA lacks the authority to regulate electronic cigarettes because they are not drug delivery devices. Soon to follow, NJOY, Inc. filed a Motion it Intervene in the case which was granted and advanced, for the most part, the same allegations as SE, The FDA was quick to counter SE and NJOY and filed a brief in opposition to SE's Motion. contending that electronic cigarettes are indeed both a drug and a device, and that Brown does not exempt them from FDA’s jurisdiction. Additionally, FDA argues that SE’s marketing practices purport that electronic cigarettes are intended to "prevent, treat, or mitigate the withdrawal symptoms of nicotine addiction," thereby squarly placing them within the FDA's jurisdiction as this would consitute a "drug" subject to full regulation. The FDA was also quick to dispute SE’s claim that the Brown Court forecloses FDA regulation of all nicotine products in general, stating that Brown only foreclosed regulation of tradional tobacco products and the electronic cigarette simply can not enjoy the sanctity of the Brown holding as it is not a traditional tobacco product, but rather a nicotine deliver system. In the interim of the filing of this action by SE, On June 22, 2009, the Family Smoking Prevention and Tobacco Control was signed into law. This historic legislation granted authority to regulate tobacco products to the U.S. Food and Drug Administration. The Honorable Justice, Richard J. Leon, who is assigned this case in Federal District Court in Washington D.C. requested a rehearing and further briefing from the parties after the enactment of this litigation. This delayed SE’s and NJOY’s request for injunctive relief right though the summer and into the fall. In September, ASH filed an Amicus Curiae (Friend of the Court) Brief in Support of the FDA, followed by another Amicus Curiae Brief filed ad hoc by a group of E-cigarette users called the Alliance. On January 14, 2010, some 10 months after this litigation was first filed, the Honorable Judge Leon issued a ruling, granting SE and NJOY a Preliminary Injunction against the FDA to stop the FDA embargo against SE and NJOY’s products coming into the United States. See Attachment 7111. The FDA quickly requested an Interlocutory Appeal and a Stay of Judge Leon’s ruling. On February 2, 2010, the Appeals Court (DC Circuit), issued an Administrative Stay of Judge Leon’s ruling and on March 31, 2010, the Court granted the FDA’s Request for a Stay of Judge Leon’s ruling pending the Appeal. The Court also denied SE’s and NJOY’s Motion to Strike the Stay. We pick up the Case at this juncture on Appeal. CONSIDERATIONS: No matter how the Appeals Court or Judge Leon rules, the e-cigarette is going to be subject to regulations. If the Court determines the E-cigarette to be a "tobacco" product, the FDA will not be able to ban it, but would be able to make reasonable regulations such as no flavorings and a reduction in nicotine levels. The FDA can also mandate many other reasonable regulations such as possibly tamper proof and "dose specific" cartridges thereby rendering bulk e-liquid banned. Should the Court find that the E-cigarette is in fact a medical device and drug combination, then the FDA can ban the E-cigarette until the requisite applications are made by Manufactures or Suppliers and studies are done in an effort to gain FDA approval which is a very time consuming and costly venture with no guarantees of approval.     So every business day that the Court is open, I will be checking the Docket Sheet and reporting here what, if anything happened with the case as this case will ultimately determine the future of our Electronic Cigarettes and how we use them.     The situation is indeed one of great concern to all who use the electronic cigarette as an alternative.

  4. It depends on the person really. If 11mg works for you then go for it Then when your ready step down to 0mg. In fact that would be awesome as you could finally let go of nicotine. I know personally I notice a difference and could not vape on 0mg. I think if you where able to get down to the 0mg strength after a while you probably wouldn't want to vape anyway.

  6. My guess (and always had been) control over the liquid. Once you control the liquid you control it all. It could go a couple of ways. 1. Outright ban and some serious fines scaring off suppliers. 2. Control of the liquid via cartomizers or something similar. No more bottles liquid. Tax per 5 pack. Now some of you are thinking "oh well I'll just get my own stuff from China" yea..right. The moment big supplier stop buying liquid in bulk and moment China stops selling it. Sure there are a few off sites selling liquid, atomizers etc in bulk but that's only because the large factories make so much of it for us larger suppliers. Once we start switching to cartomizers factories will stop selling large amounts of liquid. And think about it, when cigarettes taxes went up before electronic cigarettes HOW many of you actually went to a tobacco farm and said "hey, I'll take 200lbs of raw Tobacco please" It's just not likely. And in the event of a ban and current suppliers dwindle away the factories in China will also shut down. I've spoken with them and many have said if the US stops buying electronic cigarettes it's only a matter of time before they start shutting down.
  7. Yes customs takes hardware and liquid. The hardware is considered a "new drug delivery device"
  8. Many of you might not be aware but recently the FDA had a breakthrough in the SE, NJOY vs. FDA case. The FDA has been granted permission again to start seizing any electronic cigarette shipments coming into the states. Not only are they going after suppliers but they're starting to go after consumers as well. For those of you ordering direct from China, congratulations you may start getting a taste of what we (as suppliers) deal with on a monthly basis, costing us literally thousands of dollars. The FDA is getting serious and they're not messing around.   11. It needs to get sent to Vaprlife but (IMPORTANT) You need to make sure you contact whoever you purchased it from first. If you purchased it from Vapor Talk you need to contact us for an RMA number. (His order number will need to be sent as well) Vaprlife will not repair units without an RMA number
  12. He is correct you usually will need to purchase new batteries and atomizers over time. Although 3 months doesn't seem like a long time it's much better than it used to be. It's also MUCH cheaper than smoking cigarettes. I would suggest going with (like we always say ) They Joye 510, Janty Ego (which uses a 510 atomizer but has VERY long battery life plus a long warranty) The nice thing about sticking with the 510 series is it's almost becoming a standard. Their are cartomizers now on the market for the 510 making it pretty much the most universal device on the market. The atomizers for the 510 also work on most newer custom mods. A Joye 510 will run you about 50 bucks and is very user freindly.   13. Ouch you took it apart! Jeso will love that lol. Vaprlife offers an out of warranty option. They will repair and refurbish any broken unit for $30. Just purchase the option on their site and send that sucker out. Jeso usually gets the unit fixed pretty quick. He'll also replace any worn out parts.
  14. I think it's a mix of things. Some people get bored and want something different. Others just like one feature over the other. For example some members LOVE cartomizer models because they don't leak and don't have to be refilled as often. However others I hate them because they don't feel the throat hit or flavor is as strong. It's all preference really
  15. Well you've got a couple off choices. 1. You can upgrade to something like the Janty eGo which has a 6 month warranty and batteries that last about 10 hours a piece. It also uses the 510 atomizer so you can stick with what you know and like. 2. Buy a couple more mega batteries which will save you quite a bit more money. Other than that if your happy I see no real reason to upgrade to anything larger
  16. That's a lot of liquid for someone to have on hand. Seems a little extreme.
  17. Glad everything is working out! Not sure how I missed this post Sometimes the center poll on the custom units will go bad (under warranty so not an issue) but most of the time those batteries are the real culprit. You just can't find 3.6 volt batteries in the states. China is our only option But battery junction is awesome! Rather than sell the batteries at mark up I just send everyone over to Battery Junction. Win win for everyone
  18. I'm guessing your direct dripping like most of us. The upside to direct dripping is the great amoung of vapor and flavor. The down side..well the leaking. When you drip you need to try and make sure your only dripping what your going to use.
  19. Now that's a great way to enter into the forum. Welcome I can't agree with you more. My wife and I just had our first child and we both faced some criticism when my wife wouldn't take the flu shot immediately while pregnant. It wasn't that she didn't want it but rather than her and I wanted a Thermasol free vaccine. (She did end up with the shot but only after finding a DR's office with single dose shots) Finding single dose shots vs. multi dose shots became quite a challenge. The amount of ethyl mercury inside some of these multi dose shots shots just gives me the chills. This of course all done in the name of money because single dose shots are just "to expensive". Our next challenge will be making sure the MMR shot isn't given all at once. But your correct it is very sad but not surprising that a product with so much potential has so much against it. For years people joked "why can't they create a safer cigarette with all this technology we have" bam here we are. Now I'm not saying the electronic cigarette is safer, I can't, legally. But I do think common sense says this has to be better. I wouldn't say it's 100% safe but it's one heck of a start. Anyway welcome to the forums, glad to have you here

  21. From what I understand it's longer with longer carts. Which of course = longer cart life. Yes it should work with normal 510 batteries as I believe it's the same fitting. I believe the same as above. Yes they should work fine with any 510 battery although I would imagine because the resistance is lower it would suck up battery life a bit faster. The point of low res atties is to give a "5 volt feel" while using a 3.6 volt battery. (Get's hotter faster) I'll forward this thread over to Word Up to make sure.

(Although that forum is probably a little harder to keep track of) But about page 4-5 is when a mod should have locked things down. (Or someone should have at least reported it) Right around the time everyone started acting like children. Although I have to say post #52 was classic and had me cracking up. Bottom line is the general public is ignorant. The FDA/Government/Paid of Senators can/will use anything negative about electronic cigarettes to help enforce a ban.   23. +1 To burns comment. It's rare I use more than 2 atomizer at a time. 1 for my high volt device and another for my day to day eGo.
